Terms of Service

1. About these terms

These terms are the agreement between you and Discreet Models (“we”, “us”) about your use of our website, our application form and our creator portal. By using any of them you accept these terms. If you do not accept them, please do not use the site.

Our Privacy Policy explains what we do with personal information and forms part of these terms. Questions about either go to info@discreetmodels.com.

2. You must be 18 or over

This is an adult service and it is restricted to adults without exception. You may only use this site, apply to us, or work with us if you are 18 years of age or older, and you must confirm that before the application form will show you any of its questions.

We verify age before anyone is represented and we keep a record of it. Declaring an age that is not yours ends the relationship immediately, voids anything agreed with us, and will be reported where we are required to report it.

3. Applying to join

Submitting an application is not an agreement, and nothing on this site is an offer of representation. We decide who we take on, we are not obliged to give reasons, and we may decline or stop considering an application at any point.

When you apply you confirm that:

• the information you give us is true, and it is your own;
• any photographs you upload are of you, taken with your knowledge, and yours to share with us;
• the accounts and profiles you tell us about are yours;
• you are applying on your own behalf and nobody is applying for you.

We may ask for identification or further verification before going any further, and we may decline to proceed if it is not provided.

4. The management agreement is separate

If we decide to work together, the commercial relationship is set out in a separate written management agreement — what we do, what we are paid, how and when you are paid, how either of us can end it. These terms do not create that relationship, do not commit us to offering it, and do not vary it. Where a signed management agreement and these terms disagree, the management agreement wins.

5. Your account and the creator portal

Approved creators get access to a portal for uploading and reviewing content. Sign-in is by a single-use link sent to your email address, so the security of that email account is the security of your portal account: keep it to yourself, do not forward sign-in links, and do not let anyone else use your account.

Tell us at info@discreetmodels.com as soon as you think someone else has had access. We may suspend or withdraw access to the portal where we reasonably believe it is being misused, where an account is compromised, or where these terms have been broken.

6. Content you give us

By uploading or sending us any photograph, video or other material, you confirm that:

• you were 18 or over when it was made, and so was every person appearing in it;
• you own it or otherwise have the right to give it to us for the purposes below;
• everyone appearing in it, and anyone else whose rights are involved, has agreed to it being produced and published;
• it does not break the law and does not infringe anyone else’s rights.

You keep ownership of your content. You give us a licence to store it, organise it, edit and adapt it for publication, and publish it on the accounts and platforms we manage for you — for the purpose of providing our service and on the terms of the management agreement between us. Anything beyond that needs your agreement.

We may decline to publish, or remove, any material we consider unlawful, in breach of these terms, or against the rules of the platform it would appear on.

7. What is not allowed

You must not send us, ask us to publish, or use this site for:

• any material involving anyone under 18, or appearing to involve anyone under 18;
• any material produced without the full and informed consent of everyone in it, or involving anyone unable to give it;
• material depicting non-consensual acts, serious violence, animals, or anything otherwise illegal to produce, hold or distribute;
• anyone else’s content, name, likeness or trade marks without their permission;
• impersonating another person or misrepresenting who you are.

You must also not:

• attempt to gain access to any part of the site, or to any account, that is not yours;
• scrape, copy or systematically collect content or data from the site;
• interfere with the site’s operation, security or availability, or attempt to bypass any limit or protection on it;
• submit applications automatically, in bulk, or on someone else’s behalf.

8. Our site and our brand

The design, text, photography, video and the Discreet Models name and logo on this site belong to us or to our licensors and are protected by copyright and trade mark law. You may read and share the pages as you would expect to; you may not copy, republish or use any of it commercially, or hold yourself out as connected with us, without our written permission.

9. Earnings figures

Any figure on this site is an average or an example drawn from creators we currently work with. It is not a promise, a projection or a guarantee of what you would earn. What anyone earns depends on the content they produce, how much of it, their audience, the platforms involved and a great deal we do not control. Do not treat anything on this site as an assurance of income.

10. Third-party platforms

The accounts we manage sit on platforms we do not own or control, and your use of them is governed by their own terms as well as these. Those platforms can change their rules, their payouts or their features, and can restrict or close accounts, at their discretion. We are not responsible for their decisions, their availability or their handling of your information, and we cannot guarantee any outcome that depends on them.

11. Availability of the site

We provide the site and the portal as they are. We work to keep them available and accurate, but we do not guarantee uninterrupted access, and we may change, suspend or withdraw any part of them — including for maintenance — without notice. Keep your own copies of anything you upload; the portal is a working tool, not an archive.

12. Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

Subject to that, and to the fullest extent the law allows, we are not liable for loss of profit, loss of earnings or business opportunity, loss or corruption of data or content, or any indirect or consequential loss arising from your use of this site or the portal. If we work together, the management agreement between us governs our liability under that relationship.

You are responsible for any loss we suffer because you broke these terms — in particular because material you gave us was not yours to give or should not have been published.

13. Ending access

You can stop using the site at any time, and you can ask us at info@discreetmodels.com to close your portal account and delete the information we hold, subject to what the Privacy Policy says about the records we have to keep. We may withdraw access to the site or the portal where these terms have been broken or where we reasonably need to. Ending access does not by itself end a management agreement, which has its own notice terms.

14. Changes to these terms

We may update these terms as the service changes. The date at the top always reflects the current version, and continuing to use the site after a change means accepting it. If a change materially affects creators we already work with, we will tell them directly.

15. Governing law

These terms, and any dispute arising out of them, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the UK, you may also bring proceedings in the courts of the part of the UK you live in. Nothing here removes rights you have as a consumer that cannot be removed by agreement.
